OpenSurgery.ai and its affiliates (“OpenSurgery.ai”, “us”, “our”, or “we”) is the creator and owner of an AI-powered surgical video analysis platform comprised of tools for surgeons and medical researchers including: (1) video content management software; (2) AI-driven surgical phase identification and instrument detection; and (3) visual analytics and reporting (collectively “Product”), available through our website (“Site”). These Terms of Service (“Terms”) govern your access and use of our Site and any services available thereon, including but not limited to the Product, Content, Derivative Works and Reports (all as defined below) (collectively, “Services”). Our Privacy Policy (“Privacy Policy”) governs our collection, processing and transfer of any Personal Data (as such term is defined in the Privacy Policy). “You” means an individual using the Services independently or in the context of an agreement we have entered with a hospital or institution with which you are affiliated (“Institution” and “Customer Agreement”, respectively).
Please read these Terms carefully. By clicking on the button marked “I agree” or by accessing or using any part of the Services, you signify your assent to these Terms. Changes may be made to these Terms from time to time. If you do not agree to any of these Terms, please do not use the Services.
In the event of a conflict between these Terms and a Customer Agreement we have entered with an Institution with which you are affiliated, the provisions of such Customer Agreement shall prevail.
Use of Services
The Product houses and analyzes video data from surgical operations and is intended to be utilized by surgeons and medical researchers to review and analyze prior surgeries for educational and research purposes. The Product does not provide real-time feedback to the surgeon during surgery and is not intended for use in making treatment decisions for patients.
OpenSurgery.ai allows you to access the Site and use the Services subject to these Terms. OpenSurgery.ai may, at its sole discretion and at any time, modify or discontinue providing the Site or Services or any part thereof without notice.
Use of the Services is void where prohibited by law. By using the Services, you represent and warrant that (a) any and all registration information you submit is truthful and accurate; (b) you will maintain the accuracy of such information; (c) you are 18 years of age or older and have the ability to form a binding contract; and (d) your use of the Services does not violate any applicable law or regulation or any obligation you may have to a third party.
Once you have registered an account you will be able to upload User Content (as defined below), which will be processed by the Services (the results of such processing, “Derivative Works”). The Services shall provide you with information in respect of the videos and data provided by you through the Services (“Reports”). Reports may include AI-generated surgical phase timelines, instrument detection results, key event highlights, and analytics related to videos and data uploaded. In your account you will be able to view any historical User Content uploaded by you and associated Reports.

If you are an Administrator, you represent and warrant that you received any necessary consents and have the full right and power to provide OpenSurgery.ai with any Personal Data that you provide for registration purposes.

You are fully and solely responsible for the security of your computer system and/or mobile device and all activity on your account, even if such activities were not committed by you.
